First make sure that you followed all steps described in upgrade doc: http://ez.no/doc/ez_publish/upgrading/upgrading_to_3_8/from_3_6_x_or_3_7_x_to_3_8_0
Next check for possible errors in var/log/error.log try enable debugoutput (site.ini).
It looks like your eZ Publish run in NON-virtual host mode and where PHP runs as CGI ( question mark in URL). You can write Apache mod_rewrite rule. See also documentation for http://ez.no/doc/ez_publish/technical_manual/3_9/installation/virtual_host_setup and http://ez.no/community/forum/install_configuration/remove_question_mark_from_php_cgi_uri
Note that PHP CGI is not recommend for eZ Publish.
